For the purposes of this Refund & Payment Policy (“Policy”):
This Policy governs all payments, sponsorships, charges, remittances, and financial transactions involving the Company.
By making a purchase, submitting payment information, or engaging with any Services, the Customer:
This Policy forms an integral part of the Company’s Terms & Conditions.
ALL SALES ARE FINAL, ABSOLUTE, AND NON-REFUNDABLE.
This includes, without limitation:
No refunds, cancellations, reversals, or credits shall be issued except where expressly and unequivocally required by governing law.
The Customer waives any right to a refund that is not mandated by statute.
Contributions to the Toy Fund:
Customer acknowledges that Toy Fund allocations are discretionary and may be used for toy purchases, packaging, delivery operations, administrative expenses, or other business-related activities at the Company’s sole discretion.
Customer expressly agrees that delivery delays of any nature do not constitute grounds for a refund, including but not limited to delays caused by:
Customer further waives the right to compensation arising from such delays.
Due to fluctuating inventory, the Company may substitute toys or gift items as necessary.
Substitution does not constitute non-performance and does not entitle the Customer to a refund, credit, or partial reimbursement.
No refund or credit shall be issued for:
The Customer bears exclusive responsibility for providing accurate information.
Customer expressly agrees not to initiate chargebacks except where required by applicable law.
Impermissible chargebacks include those based on:
Improper chargebacks constitute breach of contract, entitling the Company to seek:
By submitting payment information, Customer:
The Company reserves the right to pursue all available legal and equitable remedies, including but not limited to:
This Policy shall be enforced to the fullest extent permitted by law.
This Policy is governed exclusively by the laws of the State of Texas.
Any dispute shall be resolved solely in a court of competent jurisdiction in Travis County, Texas.
Customer irrevocably waives any challenge to jurisdiction or venue.
The Company may modify, amend, or revise this Policy at any time, with or without notice.
Continued use of the Services constitutes binding acceptance of all revisions.
