REFUND & PAYMENT POLICY

CHRISTMAS DELIVERIES — REFUND & PAYMENT POLICY

Effective Date: 12/2/2025
Governing Jurisdiction: State of Texas

1. Definitions

For the purposes of this Refund & Payment Policy (“Policy”):

  • “Company,” “We,” “Us,” or “Our” refers to Christmas Deliveries, owned and operated by Tristan James Gunderson, a Texas sole proprietorship.
  • “Customer,” “You,” or “Your” refers to any individual or entity purchasing or interacting with the Company’s Services. 
  • “Services” include Christmas tree delivery, holiday delivery offerings, gift procurement, packaging, logistics, and Toy Fund participation. 
  • “Toy Fund” refers to the Company’s discretionary, for-profit community gifting initiative. 

This Policy governs all payments, sponsorships, charges, remittances, and financial transactions involving the Company.


2. Binding Nature of This Policy

By making a purchase, submitting payment information, or engaging with any Services, the Customer:

  • Affirms full understanding of this Policy
  • Accepts these terms as a condition of the transaction 
  • Waives any conflicting or contrary policy or expectation 

This Policy forms an integral part of the Company’s Terms & Conditions.


3. Strict No-Refund Policy

ALL SALES ARE FINAL, ABSOLUTE, AND NON-REFUNDABLE.

This includes, without limitation:

  • Christmas tree deliveries 
  • Holiday deliveries 
  • Gift procurement services 
  • Scheduling fees 
  • Administrative fees 
  • Delivery charges 
  • Processing fees 
  • Toy Fund contributions 
  • Any and all discretionary add-on services

No refunds, cancellations, reversals, or credits shall be issued except where expressly and unequivocally required by governing law.

The Customer waives any right to a refund that is not mandated by statute.


4. Non-Refundability of Toy Fund Contributions

Contributions to the Toy Fund:

  • Are voluntary commercial payments 
  • Are not charitable donations 
  • Are not tax-deductible 
  • Are not held in trust or escrow 
  • Are not refundable under any circumstance

Customer acknowledges that Toy Fund allocations are discretionary and may be used for toy purchases, packaging, delivery operations, administrative expenses, or other business-related activities at the Company’s sole discretion.


5. Delivery Delays Do Not Create Refund Entitlement

Customer expressly agrees that delivery delays of any nature do not constitute grounds for a refund, including but not limited to delays caused by:

  • Weather 
  • Traffic 
  • Supply shortages 
  • Contractor availability 
  • High seasonal demand 
  • Carrier or transportation issues 
  • Safety concerns 
  • Force majeure events 

Customer further waives the right to compensation arising from such delays.


6. Substitution of Items Does Not Create Refund Entitlement

Due to fluctuating inventory, the Company may substitute toys or gift items as necessary.
Substitution does not constitute non-performance and does not entitle the Customer to a refund, credit, or partial reimbursement.


7. No Refunds for Customer Error

No refund or credit shall be issued for:

  • Incorrect addresses provided by Customer 
  • Inability to receive delivery at the scheduled time 
  • Customer unavailability 
  • Customer-initiated duplication of orders 
  • Misinterpretation of Toy Fund allocation 
  • Misunderstanding of delivery windows 

The Customer bears exclusive responsibility for providing accurate information.


8. Chargeback Prohibition and Waiver

Customer expressly agrees not to initiate chargebacks except where required by applicable law.

Impermissible chargebacks include those based on:

  • Disagreement with the no-refund policy 
  • Toy Fund allocation or usage 
  • Delivery timing 
  • Third-party receipt of gifts 
  • Item substitutions 
  • Customer misunderstanding of the commercial nature of contributions

Improper chargebacks constitute breach of contract, entitling the Company to seek:

  • Recovery of disputed amounts 
  • Legal fees 
  • Collection costs 
  • Interest 
  • Account termination 
  • Any other remedy available under Texas law
     

9. Payment Authorization

By submitting payment information, Customer:

  • Authorizes the Company and its payment processors to charge the full amount 
  • Certifies that they are legally permitted to use the payment method 
  • Assumes responsibility for all charges incurred 
  • Acknowledges that payments may appear under the trade name Christmas Deliveries or the legal name Tristan James Gunderson
     

10. Enforcement and Legal Remedies

The Company reserves the right to pursue all available legal and equitable remedies, including but not limited to:

  • Collection actions 
  • Interest on unpaid amounts 
  • Attorney’s fees 
  • Civil litigation 
  • Reporting fraudulent chargebacks to payment processors 

This Policy shall be enforced to the fullest extent permitted by law.


11. Governing Law & Venue

This Policy is governed exclusively by the laws of the State of Texas.
Any dispute shall be resolved solely in a court of competent jurisdiction in Travis County, Texas.

Customer irrevocably waives any challenge to jurisdiction or venue.


12. Modifications to This Policy

The Company may modify, amend, or revise this Policy at any time, with or without notice.
Continued use of the Services constitutes binding acceptance of all revisions.
